Can I Sue a Spouse for a Personal Injury?

The prohibition against spouses suing each other is often referred to as “interspousal immunity.”

This immunity would prevent spouses from successfully prevailing in a civil cause of action for recovery of damages for a personal injury.

Interspousal immunity was part of the common law, decisions made by courts and treated as precedent for many future cases. However, the vast majority of states have now abolished interspousal immunity.
